• Secured favorable settlement of copyright infringement and unfair competition claims asserted on behalf of a client against one of the largest Internet portals. The copyright infringement claims were tacitly recognized by the Internet portal as being validly asserted under exceptions to the Digital Millennium Copyright Act.
• Secured a settlement in a case involving copyright and trade dress infringement of a plaintiff's Web site. Settlement required defendant to shut down its infringing Web site and pay plaintiff's attorney's fees.
• Represented defendant insurance company and its law firm against a claim of infringement of a copyrighted and confidential financial plan. Secured a favorable settlement, which avoided filing of serious and potentially embarrassing infringement claims.
• Represented a national retailer in the defense of two separate actions for patent infringement, trade dress infringement and copyright infringement involving the design of a flashlight. A successful personal jurisdictional challenge and vigorous defense of a preliminary injunction motion led to a win-win settlement providing additional sales to both the plaintiff and our client, and at no cost to our client.
