  • Secured exclusive rights to use popular patriotic symbols as a mark for nationwide use by a national financial institution, through cancellation proceedings brought against a harmful registration in the U.S. Patent & Trademark Office. The financial institution sought to expand use of the mark and associated services offered by an acquired branch office.
  • Implementing national trademark-policing programs, numerous trademark opposition and cancellation proceedings that have been brought in the U.S. Patent & Trademark Office as well as enforcement actions in U.S. District Courts. Through the proceedings, trademark rights were substantially strengthened by obtaining the withdrawal, amendment, refusal or cancellation of dozens of applications or registrations for confusingly similar marks. Representative markets include retail clothing stores, real estate development, computer network equipment, telecommunications, financial services, radio broadcasting and entertainment, amongst others.
  • Importation of products bearing an infringing mark was curtailed by notifying U.S. Customs of a federal registration of the mark and the identity of the importer. Following an opinion of infringement by U.S. Customs, the product was withdrawn from the U.S. marketplace.
